These terms and conditions form the basis on which you can visit and use the nethertons.com website. Please read them carefully as they contain important information.

Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission. You may not modify, delete, distribute or post anything on this website for any purpose.

Every care has been taken in the preparation of the content of this website, to ensure that the details, descriptions and prices quoted are correct at the time of publishing. All prices include VAT.

All copyright of this website and content including logo’s, artwork and images belongs to Nikki and James Warren. No content, artwork or images can be used or reproduced in any way without the Artists consent. Shirley Netherton retains the copyright for all her artwork, sold and unsold.

Use of the site / Accuracy

We take every effort to ensure that the content of the site is accurate and up to date. We reserve the right to amend any errors or omissions at our discretion and will endeavour to do so at the earliest opportunity. It should be noted that the colours and appearance of artwork or products may vary slightly from the way they appear on the screen, due to the resolution of the images used on the website.

We reserve the right to change the Terms & Conditions, with the new version taking effect from the time of being published onto the site. If you have any questions, comments or concerns arising from the website, the privacy policy or any other relevant terms and conditions, policies and notices or the way in which we are handling your personal information please contact us.

Netherton’s may modify this agreement at any time by updating this page.  By using our website, you agree to be bound by any such revisions. 

Orders

Placing an online order is easy, quick and secure. At time of checkout, you will be asked to provide your name, address for shipping, email address and telephone number. This information should be up to date, true and accurate. If any of this information changes in the future, you are required to amend your details before placing any further orders. 

Simply browse through the gallery and add any items you wish to purchase to the cart. You will have the opportunity to check the details of your order and correct any errors before placing the order.  When you place your order, you are making an offer to buy. You may then choose to pay by debit or credit card. You will be sent an acknowledgement e-mail confirming receipt of your order. At this time, a legally binding contract will be formed, and your goods will be dispatched to you.

All items are subject to availability. In the event we are unable to comply with our obligations due to circumstances beyond our reasonable control, we shall not be liable for such inability to comply with our obligations or resulting delays.

Payment & Pricing

The prices payable for the goods that you order are as set out in our website in £s sterling and include VAT. Shipping will be calculated at checkout.  

You may pay by debit or credit card. This is via a secure server – you can check this by looking for the closed padlock at the bottom of your browser window at the payment stage. No credit/debit card information is stored on the Netherton’sserver at any time.

We will charge your account for payment upon receipt of your order unless delivery cannot be fulfilled within 30 days. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account, then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.

Delivery

We cannot accept any liability for any loss or damage to the products once they have been delivered unless this is caused by our negligence. We will endeavor to deliver within 14 days or sooner. International delivery will take longer. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended.

Cancellations & Returns

We offer a 14-day money back guarantee. You may cancel from the day of the order and up to 14 working days after the day on which you receive your goods (this exceeds the statutory minimum of 7 days). If you wish to cancel, please e-mail us at info@nethertons.com We must have written notice of your cancellation.

You will receive a full refund within 30 days of cancellation in the same format that you paid for the goods. The goods must be returned in their original condition and packaging (or similar packaging to ensure safe transit) within 7 working days of original receipt. Return postage will be at your cost, using Special Delivery or equivalent with adequate insurance cover. Alternatively return collection via a courier can be arranged, the cost of this service will be deducted before your refund is given.

You should include a note with details of your name and address and if possible, a reason for the return.

Netherton’s will endeavor to ensure that all products are securely packaged so that they arrive intact. However, we recommend that you check the condition of your purchase when it is delivered. If the product/s you receive is damaged or incorrectly supplied, please inform us within 7 working days of delivery. We will arrange for any faulty or damaged original art to be collected from you so that you do not incur any expense. For smaller items, we will pay the cost of return postage. Please note that we will not accept the return of any damaged or incorrectly supplied goods where you fail to notify us of this within 7 days of receiving them.

We reserve the right to cancel the contract between us if the goods are not available or if the goods were listed at an incorrect price due to a typographical error. If we do cancel the contract, we will notify you by e mail and will re-credit your account any sum deducted by us as soon as possible but within 30 days of your order.

Privacy & Security

We are committed to protecting your privacy and will only use the information that we collect lawfully (in accordance with the Data Protection Act 1998).

Information is collected for 2 reasons: firstly, to process your order and second, to provide you with the best possible service. The type of information collected about you includes:

  • your name and address
  • telephone number
  • email address
  • correspondence relating to your order/enquiry

All online transactions are processed by Stripe – we have no access to your Credit/Debit Card details, therefore no information about these is held. Sensitive information about you will not be collected without your explicit consent.                       

The personal information held will be accurate and up to date. You can check the information by emailing us and any inaccuracies will be deleted or corrected promptly. Under the GDPR act, you have the right to be forgotten.  If you wish to invoke this, please contact us and we will erase all personal information held about you.

You will not receive emails in the future unless you have given your consent.

This website does use Cookies. These are pieces of information from your browser stored on your hard drive which provide demographic information about visitors to the website. They cannot be accessed by a third party and all data and privacy is secure. We do not provide your personal details to other companies or individuals for their marketing purposes.
